AVAILABILITY AND PRICING

Availability and pricing of all items are subject to availability. Smart Deal will inform you as soon as possible, if the product(s) and services you have ordered are not available. If not, then the Customer Care will offer similar alternatives. As part of visiting and/or purchasing anything from Smart Deal, you warrant to agree to understand that due to the nature of the business, availability may change even after an order has been placed. In an event where the product is no longer available, the Customer Care will offer alternatives or the option to cancel your order wholly.

All prices are subject to change without notification, and while every effort is made to ensure the accuracy of the prices displayed on Smart Deal, they are not guaranteed to be accurate. If any price is different from that displayed, we will inform you before dispatching the order and you will have the option of continuing with the order or not. We reserve the right at any time to modify or discontinue any Service (or any part or content thereof) without notice at any time. We shall not be liable to any customer or to any third-party for any modification, price change, suspension or discontinuance of the Service.

PRODUCTS

Products are available exclusively online through Smart Deal. These products or services may have  quantities and are subject to return or exchange only according to our Return and Replacement Policy.

Smart Deal has made every reasonable effort to be as accurate as possible in displaying the product in its original color and accurate model. However, due to your device’s display settings, technical issues and differences in display, variations may come to the product’s color or size. Hence, Smart Deal cannot guarantee that the physical product will look exactly like the display image. If a product from Smart Deal is not as described, your sole remedy is to return it unused by fulfilling all the conditions as per our Return and Replacement Policy.

We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer, at any time. All descriptions of products or product pricing are subject to change at any time without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time.

স্মার্ট ডিলের মাধ্যমে পণ্য গুলি অনলাইনে উপলব্ধ/প্রাপ্য। এই পণ্য বা সার্ভিসের/সেবার পরিমাণ সীমিত থাকতে পারে এবং এই পণ্য বা সার্ভিস শুধু মাত্র আমাদের রিটার্ন এবং রিপ্লেসমেন্ট নীতি অনুযায়ী ফেরত বা বিনিময় যোগ্য।

স্মার্ট ডিল প্রতিটি পণ্যটি কে তার আসল রঙ এবং সঠিক মডেলে প্রদর্শনের ক্ষেত্রে যথাসম্ভব নির্ভুল হয়ে যুক্তিসঙ্গত ভাবে প্রচেষ্টা করে। তবে আপনার ডিভাইসের ডিসপ্লে সেটিংস, টেকনিক্যাল সমস্যা এবং ডিসপ্লের পার্থক্যের কারণে পণ্যের রঙ বা আকারে বৈচিত্র্য আসতে পারে।অতএব, স্মার্ট ডিল গ্যারান্টি দিতে পারে না যে পণ্যটি সঠিক ডিসপ্লে করা ছবির মতো দেখাবে।যদি স্মার্ট ডিলের কোনো পণ্য বর্ণনা অনুযায়ী না হয়, তাহলে আপনার একমাত্র উপায় হবে রিটার্ন এবং রিপ্লেসমেন্ট পলিসি অনুযায়ী সমস্ত শর্ত পূরণ করে অব্যবহৃতপণ্য ফেরত দেওয়া।

ACCURACY OF BILLING AND ACCOUNT INFORMATION

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting through the phone number or e-mail provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

As a visitor or a customer, you agree to provide current, complete and accurate account information for all purchases made at our store. You also agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

Each user accounts must be created under one distinctive registered Cell Phone number, and email address of the user. Multiple accounts cannot be created under the same information as mentioned. In such an event the user cannot avail more than once any of the offers, deals, discount coupons, or Gift Coupons during campaigns or other occasional sales.

DISCOUNTS & ALLOWANCES

Discounts and allowances (Coupon code, Promo code, Gift card code, Adjustment code, App discount, Occasional offers or sign-up offer etc.) are reductions of the basic price of products or services. The value of the discount coupon or gift card will not be refunded on returns or exchanges after using for a successful order from Smart Deal. Users having multiple accounts under the same Cell Phone number, or email address cannot avail the discounts or offers more than once, as is the policy. Promotional SMS may only contain the main content of the offer but terms and conditions are mentioned on the website. Smart Deal holds the right to change/revise/modify any Discount offers OR Promotional Allowances without prior notice. Customer is entitled to comply accordingly. Customers cannot avail multiple discounts offers in a single order. For example, if a customer uses 2X vouchers then he cannot use reward points or any other discount along with the ordered item

ডিসকাউন্ট এবংভাতা

ডিসকাউন্ট এবং ভাতা হলো (কুপনকোড, প্রোমোকোড, গিফটকার্ডকোড, অ্যাডজাস্টমেন্টকোড, অ্যাপ ডিসকাউন্ট, ওকেশনাল অফার বা সাইন আপ অফার ইত্যাদি) পণ্য বা সার্ভিসের মূল্য হ্রাস করা। স্মার্ট ডিল থেকে সফল অর্ডারের জন্য ব্যবহার করার পর ডিসকাউন্ট কুপন বা গিফট কার্ডের মূল্য ফেরত বা বিনিময় যোগ্য হবে না। নীতিমালা অনুযায়ী একই সেলফোন নম্বর বা ইমেল ঠিকানার/আইডির অধীনে একাধিক অ্যাকাউন্ট থাকা ইউজাররা একাধিক বার ছাড় বা অফার পাবে না। প্রচারমূলক এসএমএসে শুধু মাত্র অফারের মূল বিষয়বস্তু থাকতে পারে কিন্তু ওয়েবসাইটে শর্তাবলী উল্লেখ করা থাকবে। পূর্ব বিজ্ঞপ্তি ছাড়াই স্মার্ট ডিল কোন ডিস্কাউন্ট অফার বা প্রচারমূলক ভাতা/এল্যাউন্স পরিবর্তন/সংশোধন/রুপান্তর করার অধিকার সংরক্ষন করে। গ্রাহককে সেই অনুযায়ী মেনে চলতে হবে। গ্রাহকরা একক অর্ডারে একাধিক ডিসকাউন্ট অফার পাবেন না।উদাহরণস্বরূপ, যদি একজন গ্রাহক ২X ভাউচার ব্যবহার করে তাহলে সে অর্ডারকৃত পণ্যের সাথে রিওয়ার্ড পয়েন্ট বা অন্য কোন ডিসকাউন্ট ব্যবহার করতে পারবেন না।

 

LICENSE TO ACCESS THE SITE

ঘ) নিজেদের বা অন্যদের বুদ্ধিগত অধিকার লঙ্ঘন করা;

ঙ) লিঙ্গ, যৌন প্রবণতা, ধর্ম, জাতি, জাতি, বয়স, জাতীয় উৎপত্তি, বা অক্ষমতার উপর ভিত্তি করে হয়রানি, অপব্যবহার, অপমান, ক্ষতি, বদনাম, অপবাদ, অসম্মান, ভয় দেখানো বা বৈষম্য করা;

চ)মিথ্যা বা বিভ্রান্তিকর তথ্য জমা দেয়া;

ছ) ভাইরাস বা অন্য কোনো ধরনের ক্ষতিকর কোড আপলোড বা প্রেরণ করা যা সার্ভিস বা সংশ্লিষ্ট ওয়েবসাইট, অন্যান্য ওয়েবসাইট, বা ইন্টারনেটের কার্যকারিতা বা কার্যক্রমকে প্রভাবিত করবে বা ব্যবহার করা যাবে;

জ) অন্যান্যদের ব্যক্তিগত তথ্য সংগ্রহ বা ট্র্যাক করা;

ঝ) স্প্যাম, ফিশ, ফার্ম, অজুহাত, মাকড়সা ক্রল, বা স্ক্র্যাপ

ঞ)কোন অশ্লীল বা অনৈতিক উদ্দেশ্যে; অথবা,

ট) সার্ভিস বা সংশ্লিষ্ট কোনো ওয়েবসাইট, অন্যান্য ওয়েবসাইট, বা ইন্টারনেটের নিরাপত্তা বৈশিষ্ট্যগুলিতে হস্তক্ষেপ বা বাধা দেওয়া।

All prices are listed in Bangladeshi Taka (BDT) and are inclusive of all Taxes and are listed on the Site by the seller that is selling the product or service. Items in your Shopping Cart will always reflect the most recent price displayed on the item's product detail page. Please note that this price may differ from the price shown for the item when you first placed it in your cart. Placing an item in your cart does not reserve the price shown at that time. It is also possible that an item's price may decrease between the time you place it in your basket and the time you purchase it.

We do not offer price matching for any items sold by any seller on our Site or other websites.

We are determined to provide the most accurate pricing information on the Site to our users; however, errors may still occur, such as cases when the price of an item is not displayed correctly on the Site. As such, we reserve the right to refuse or cancel any order. In the event that an item is mispriced, we may, at our own discretion, either contact you for instructions or cancel your order and notify you of such cancellation. SECURITY AND FRAUD

When you use a voucher, you warrant to Smart Deal that you are the duly authorized recipient of the voucher and that you are using it in good faith.

If you redeem, attempt to redeem or encourage the redemption of voucher to obtain discounts to which you are not entitled you may be committing a civil or criminal offence

If we reasonably believe that any voucher is being used unlawfully or illegally we may reject or cancel any voucher/order and you agree that you will have no claim against us in respect of any rejection or cancellation. Smart Deal reserves the right to take any further action it deems appropriate in such instances

যদি আমরা যুক্তিসঙ্গত ভাবে বিশ্বাস করি যে কোন ভাউচার বেআইনি বা অবৈধভাবে ব্যবহার করা হচ্ছে আমরা যে কোন ভাউচার/অর্ডার প্রত্যাখ্যান বা বাতিল করতে পারি এবং যে কোন প্রত্যাখ্যান বা বাতিলের ক্ষেত্রে আমাদের বিরুদ্ধে আপনার কোন দাবি থাকবে না।স্মার্ট ডিলের এইধরনের ক্ষেত্রে উপযুক্ত মনে করলে পরবর্তী পদক্ষেপ নেওয়ার অধিকার রাখে।

DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY

We do not guarantee, represent or warrant that your use of our service will be uninterrupted, timely, secure or error-free. We do not warrant that the results that may be free from error obtained from the use of the service will be accurate or reliable. User must understand that, from time to time we may remove the service for indefinite periods of time or cancel the service at any time, without prior notice to you, under different circumstances.

You expressly agree that your use of, or inability to use the service is solely your risk. The service and all products and services delivered to you through the service are (except as expressly stated by us) provided 'as is' and 'as available' for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.

In no case shall Smart Deal, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, vendors, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation, lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not  to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility.

However, any use of the product that results in any injury, loss, or damage whether direct or indirect, will not make Smart Deal liable for providing servicing facilities provided that, such direct or indirect use and the results thereof, is not covered nor supported by the provisions under the products accompanying Warranty.

আমরা প্রতিনিধিত্ব বা গ্যারান্টি দিচ্ছি না যে আমাদের সার্ভিস ব্যবহার নিরবচ্ছিন্ন, সময়োপযোগী, নিরাপদ বা ত্রুটিমুক্ত হবে।আমরা নিশ্চিত নই যে সার্ভিস ব্যবহার থেকে প্রাপ্তত্রুটি মুক্ত ফলাফল গুলিসঠিক বা নির্ভরযোগ্য হবে।ব্যবহারকারীকে অবশ্যই বুঝতে হবে যে, সময়ে সময়ে আমরা অনির্দিষ্টকালের জন্য সার্ভিস অপসারণ করতে পারি অথবা যে কোন সময়, আপনাকে পূর্ববিজ্ঞপ্তি ছাড়াই, বিভিন্ন পরিস্থিতিতে সার্ভিসটি বাতিল করতে পারি।

কোন অবস্থাতেই স্মার্ট ডিলের, আমাদেরপরিচালক, কর্মকর্তা, কর্মচারী, অধিভুক্ত, এজেন্ট, ঠিকাদার, ইন্টার্ন, সরবরাহকারী, বিক্রেতা, সার্ভিস প্রদানকারী বা লাইসেন্স প্রদানকারীরা কোন আঘাত, ক্ষতি, দাবী বা প্রত্যক্ষ, পরোক্ষ, আনুষ্ঠানিক, শাস্তিমূলক সীমাবদ্ধতা ছাড়া, হারানো মুনাফা, হারানো রাজস্ব, হারিয়ে যাওয়া সঞ্চয়, তথ্যহারানো, প্রতিস্থাপন খরচ, বা অনুরূপ কোনো ক্ষতি, যে কোনও চুক্তির ভিত্তিতে, নির্যাতন (অবহেলাসহ), কঠোর দায়বদ্ধতা বা অন্যথায় , সার্ভিস ব্যবহার করে ক্রয় করা যে কোনো পণ্যের ব্যবহার থেকে, অথবা আপনার সার্ভিস বা যে কোনো পণ্যের ব্যবহারের সাথে সম্পর্কিত অন্য কোন দাবির জন্য, যার মধ্যে কোনো ত্রুটি বা বাদ পড়লেও সীমাবদ্ধ নয় এমন সামগ্রী, অথবা সার্ভিস ব্যবহারের ফলে যে কোনো ধরনের ক্ষতি বা ক্ষতিহয়েছে অথবা কোনো সামগ্রী (বা পণ্য) পোস্ট করা, প্রেরণ করা, অথবা অন্যথায় সার্ভিসটির মাধ্যমে উপলব্ধ করা হয়েছে, তার জন্য দায়ী হবে না।

এছাড়া, সরাসরি বা পরোক্ষ যে কোন আঘাত, ক্ষতি বা ক্ষতির ফলে পণ্যটির যে কোন ব্যবহার, স্মার্ট ডিলকে সার্ভিসিং সুবিধা প্রদানের জন্য দায়বদ্ধ করবে না, ওয়ারেন্টিসহ পণ্য গুলিরদ্বারা যদি এই ধরনের প্রত্যক্ষ বা পরোক্ষ ব্যবহারএবংএর ফলাফল গুলি স্মার্ট ডিলকে অন্তর্ভুক্ত করবে না।

INDEMNIFICATION

As a user of the website and the services therein, you agree to indemnify, defend and hold Smart Dealharmless and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, vendors, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or any documents they incorporate by reference, or your violation of any law or the rights of a third-party.

 

ক্ষতিপূরণ

ওয়েবসাইট এবং সেখান কার সার্ভিসের একজন ব্যবহারকারী হিসাবে, আপনি স্মার্ট ডিলের কে ক্ষতি পূরণ দিতে, রক্ষা করতে এবংধরে রাখতে সম্মত হলেন এবংঅভিভাবক, সহায়ক, সহযোগী, অংশীদার, অফিসার, পরিচালক, এজেন্ট, ঠিকাদার, লাইসেন্সপ্রদানকারী, সার্ভিসপ্রদানকারী, সাব -কন্ট্রাক্টর, সরবরাহকারী, বিক্রেতা , ইন্টার্নএবংকর্মচারী, যুক্তিসঙ্গত অ্যাটর্নির ফি সহ কোন দাবী বা দাবী থেকে নিরুপায় আইন বা তৃতীয় পক্ষের অধিকার প্রদানে সম্মত হলেন।

SEVERABILITY

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

TERMINATION

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes. These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.

Any and all actionable legal claim or proceedings arising out of, or in connection to this website, must be brought within the jurisdiction of a competent Court in Bangladesh.
